FSSAI Registration and License

Introduction

Food Safety and Standards Authority of India (FSSAI) registration and licenses are mandatory for food businesses operating in India. The registration and licensing process varies depending on the scale and nature of the food business. Generally, small-scale food businesses are required to obtain FSSAI registration, while larger businesses need to obtain FSSAI licenses.


Here's a brief overview: 


  

FSSAI Registration: 

This is required for small-scale food businesses such as small food manufacturers, small-scale food processors, and petty retailers. The registration process is simpler and involves less paperwork.


FSSAI Registration License: 

Larger food businesses, such as manufacturers, transporters, distributors, and exporters, are required to obtain an FSSAI license. There are different types of licenses based on the size and nature of the business. The license requires more detailed documentation and compliance with specific standards.


Both registration and licensing involve adherence to food safety and hygiene standards prescribed by FSSAI. It ensures that food businesses comply with regulations to maintain the safety and quality of food products consumed by the public.


Food Business Operators Who Require FSSAI Registration? 

Food Business Operators (FBOs) in India require FSSAI (Food Safety and Standards Authority of India) registration or license, depending on the size and nature of their business operations. Here's a general guideline:


1. Manufacturers and Processors  

 Any FBO involved in manufacturing, processing, packaging, storage, distribution, and sale of food products requires FSSAI registration or license.


2. Distributors and Wholesalers 

Businesses engaged in distribution and wholesale of food products need to obtain FSSAI registration or license. 


3. Retailers

Retailers selling food products also need to register with FSSAI. However, small retailers with an annual turnover below a specified limit (usually ₹12 lakhs) can opt for FSSAI registration instead of a license. 


4. Importers and Exporters

FBOs engaged in importing or exporting food products to and from India must obtain an FSSAI license. 


5. Caterers and Hoteliers

Caterers, hotels, restaurants, food stalls, food vending establishments, and food service providers need to have an FSSAI license.


6. Transporters 

Businesses involved in transporting food products require FSSAI registration or license. 


7. Storage Operators

Entities operating warehouses or cold storage facilities for storing food products also need to register with FSSAI. 


8. E-commerce Platforms

Online platforms that facilitate the sale of food products are required to ensure that the FBOs registered or listed on their platform have valid FSSAI registration or license.


9. Food Marketers and Brand Owners: 

Individuals or companies involved in marketing and branding of food products must have FSSAI registration or license. 


It's essential for FBOs to comply with the FSSAI regulations to ensure the safety and quality of food products being offered to consumers. The specific requirements for registration or licensing may vary based on factors such as turnover, scale of operations, and the nature of food products handled. 

  

How many types of FSSAI licenses or registration? 

The specific type of license or registration required depends on the turnover, scale of operations, and the nature of the food business. It's essential for FBOs to determine their eligibility and obtain the appropriate license or registration to comply with FSSAI regulations. 


FSSAI (Food Safety and Standards Authority of India) issues three types of licenses or registrations based on the scale and nature of the food business operations: 


1. FSSAI Registration 

This is required for small food businesses. FBOs with an annual turnover below ₹12 lakhs are eligible for FSSAI registration. This registration is suitable for small-scale food businesses such as petty retailers, hawkers, itinerant vendors, etc. 


2. FSSAI State License 

This license is applicable to medium-sized food businesses. FBOs with an annual turnover between ₹12 lakhs and ₹20 crores need to obtain a state FSSAI license. This includes businesses such as small to medium-sized manufacturers, storage units, transporters, retailers, distributors, etc. 


3. FSSAI Central License 

This license is required for large food businesses. FBOs with an annual turnover exceeding ₹20 crores need to obtain a central FSSAI license. This includes large-scale manufacturers, importers, exporters, operators of food vending establishments, large retailers, etc.  


Documents Required for FSSAI Registration

  • Photo of the Food Business Operator
  • Government-issued Photo ID, including AADHAAR, PAN, Voter ID, etc.
  • Proof of the business activity address.


Documents Required for FSSAI State/Central License


A. Identity Proof of Applicant

  • PAN Card
  • Aadhaar  Card
  • Voter ID
  • Passport


B. Address Proof of Business Premises 

  • Rental Agreement/Lease Deed (if rented)
  • Property Tax Receipt or Electricity Bill (if owned)
  • NOC from the landlord (if rented)


C. Incorporation Documents(applicable for companies, LLPs, etc.)

  • Certificate of Incorporation
  • Memorandum and Articles of Association
  • Partnership Deed (if applicable)


D. Food Safety Management System Plan (FSMS)

  • A detailed plan outlining food safety management practices implemented by the food business operator.


E. List of Food Products

  • Details of the food products manufactured, processed, stored, distributed, or sold by the food business.


F. Business Details

  • Name and address of the business
  • Contact details (phone number, email)
  • Nature and type of food business (manufacturer, distributor, retailer, etc.)


G. Proprietorship Declaration/Partnership Deed/Memorandum of Association (MOA)

  • Relevant  documents demonstrating ownership/partnership details based on the business structure.


H. Layout Plan of the Premises

  • A detailed layout plan of the food business premises, showing the location of different sections such as production area, storage area, washing area, etc.


I. Food Safety Management System (FSMS) Certificate (if applicable)

  • Certification from recognized food safety management system authorities such as ISO 22000, HACCP, etc.


J. Declaration Form:

  • A signed declaration form stating compliance with FSSAI regulations and standards.


K. Other Supporting Documents

  • Analysis report (Chemical & Bacteriological) of water to be used as ingredient in food from a recognized/ public health laboratory to confirm the potable (mandatory only for manufacturing and processing units only)
  • Any additional documents requested by the FSSAI authorities or as per specific requirements based on the type of food business.
